Content rights

All rights reserved.

Copying, scraping, extracting, republishing or reusing content from Kapodalim, including event listings, guides, articles, images and catalogue data, is prohibited without prior explicit written permission from Kapodalim L.L.C. This requires completing our form and a licence agreement signed by both parties before use begins. An email approval alone is not enough. Attribution, an unanswered request or public access is not permission.

Kapodalim L.L.C. · Business no. 812456954 · Prishtina, Kosovo

Kapodalim L.L.C. operates Kapodalim, also presented as Ka' Po Dalim?. We invest in finding, checking, organizing and presenting information. This policy sets the conditions on which our website, applications and content may be accessed and used. It applies to every content category, not only events.

01

Scope

This policy covers event listings and programmes; guides and editorial articles; venue, artist and organizer profiles; directories and maps; photographs, illustrations, designs and other media; translations, descriptions, metadata and structured data; and the selection, arrangement and contents of our catalogues, feeds, APIs and downloadable materials. Protection applies to the extent of our rights and the applicable law.

It covers access through browsers, applications, extensions, APIs, feeds, automated agents, AI tools and intermediaries. Commissioning another person or a tool to collect or reuse content does not remove the requirement for permission.

02

Permission requires our form and a signed contract

Except for the narrowly defined uses expressly authorized in section 3 and rights that applicable law does not allow us to exclude, scraping, extracting, copying, republishing, distributing, adapting or otherwise reusing our content requires prior authorization through the form and contract process below.

Contact support@kapodalim.com for the permission-request form we provide. You must complete and return that form. Submitting it is an application only: it does not grant permission or oblige Kapodalim L.L.C. to enter into an agreement.

Permission is granted only through a written licence agreement signed by both the applicant, or its authorized representative, and an authorized representative of Kapodalim L.L.C. The agreement must expressly identify the recipient, the content or dataset, the permitted purpose and method, the permitted scope and the duration. Use may begin only once both parties have signed, the agreement has taken effect and all conditions required before use have been satisfied.

A standalone email approval, including one from an authorized representative, does not replace the required signed agreement. Negotiations, a completed form or an unsigned contract do not authorize use. The agreement may be signed using a legally valid electronic signature accepted by both parties and delivered electronically; its electronic delivery is not the same as approval by email alone.

Sending a request, receiving an automated acknowledgement, waiting without a reply, discussing a possible partnership, receiving general encouragement, paying for an unrelated service, creating an account, giving credit or linking to us does not constitute permission. Silence and inaction never constitute approval. Access to a page, feed, API or technical credential does not by itself grant a content reuse licence. A robots.txt allowance is not a general content licence.

Permission applies only within the signed agreement's express limits. It does not extend to another recipient, project, platform, dataset, purpose or period, and is not transferable or sublicensable unless the agreement expressly says so. Changes and renewals require a written amendment or new agreement signed by both parties, plus any updated form we require, before the changed or renewed use begins. An organizer, partner or other third party cannot waive these requirements or grant rights belonging to us without our express authority.

03

Limited ordinary use and search discovery

You may read public pages for personal information, use accessibility tools for that purpose, and use our own available functions to save an event or plan within the service. You may share a canonical link to a page, including the standard preview produced by our sharing function or the receiving platform. This does not authorize copying the page, its artwork or its description into a separate publication or database.

We give a limited public authorization to genuine search and discovery services to access indexable public pages for indexing and to display linked search results, ordinary previews and brief attributed excerpts or summaries that help users find and visit the relevant Kapodalim page. This includes search-assisted answers that cite the relevant page. Associated technical indexing copies are permitted only for that discovery purpose. These services must respect applicable crawl and access controls.

This authorization is not a licence to supply our catalogue to third parties, publish substitute event or guide pages, assemble a competing dataset, train or fine-tune models, or obtain unrestricted access to bulk feeds. It does not authorize end users or agents to harvest the website under the label of search. Other uses require section 2 authorization unless independently permitted by mandatory law.

04

Prohibited extraction and reuse

Without the authorization required above, you must not collect our content through scraping, crawling, harvesting, bulk downloading, automated browsing, API extraction or systematic manual collection for republication or another dataset. This includes repeated collection of small portions intended to reconstruct all or a substantial part of the catalogue.

You must not use extracted content to populate another website, app, newsletter, guide, commercial social account, event directory, recommendation service or resale product. Rewriting, translating, paraphrasing, changing the layout or generating new artwork from collected material does not itself supply permission for an otherwise restricted use.

You must not create a clone, mirror, replacement service or derivative catalogue from our content; remove or conceal rights notices or provenance as part of unauthorized reuse; falsely present our editorial work as your own; or imply endorsement, affiliation or partnership that does not exist. Adding credit does not cure missing permission. Removing our name, changing URLs or concealing the collection method does not create permission or alter the underlying conduct.

You must not evade access restrictions or quotas, use credentials without authority, impersonate an approved crawler or client, or distribute an extraction operation across accounts or services to defeat controls. Applicable statutory rights remain unaffected.

05

AI systems and text and data mining

We reserve the rights we hold to authorize text and data mining, model training, fine-tuning, evaluation datasets and the ingestion of our protected content into reusable retrieval collections. No such licence is granted by public availability, robots access, an API response or the search permission in section 3.

Where applicable law permits rights to be reserved against text and data mining, this policy expresses that reservation. We may communicate it through supported machine-readable mechanisms as well. This reservation does not displace an exception that the applicable law makes non-waivable. A tool operator must determine whether its use is actually authorized; a user's instruction to copy the website is not permission from us.

06

APIs and approved integrations

Being able to access a data feed or integration is not permission to reuse its contents. Our applications and approved integrations may use information only for their authorized purpose. A separate third-party integration requires completion of our form and a signed agreement under section 2 defining its scope, access limits, storage, redistribution, attribution and termination.

We may limit bulk collection or suspend abusive access, subject to applicable law and any agreement. This policy does not guarantee uninterrupted access or that every unauthorized use will be prevented.

07

Rights belonging to others and independent research

We do not claim ownership of an event itself, an independently obtained fact, an idea, or every image and announcement supplied by an organizer. Third-party materials remain subject to their owners' rights. Our claim concerns our own protected expression, design, brand, qualifying selection and arrangement, and any database or other rights available under applicable law. We cannot grant rights we do not hold.

This policy does not prevent genuinely independent research using an organizer's original sources, subject to those sources' rights and terms. It does not confer exclusivity over organizers, venues, artists or commercial relationships. Legal rights of quotation, accessibility, research or other mandatory exceptions remain available where their actual conditions are met. Those rights are not implied consent from Kapodalim L.L.C.

08

Enforcement and requests

If we identify suspected unauthorized use, we may preserve relevant evidence, request cessation and removal, restrict access, terminate an applicable permission in accordance with its terms, and seek remedies available under the applicable law. Depending on the facts, those remedies may include an injunction, compensation for proven loss and recoverable costs. No automatic fine, guaranteed court outcome or criminal liability is created by this policy.

An inquiry or an API request is not itself an infringement. To apply for permission, request our form at support@kapodalim.com and identify the relevant pages, intended use and person or organization responsible. You may also use that address to report an error or dispute a restriction. Do not send unnecessary personal or confidential information. No restricted use may begin before the form and signed-agreement requirements in section 2 are fulfilled.

09

Relationship to other terms

This policy forms part of our Terms of Use. An agreement signed under section 2 controls the specific use it covers; no broader permission is inferred. Applicable mandatory law prevails over an inconsistent provision. New versions take effect only on their published effective date and do not retrospectively create a breach or revoke an existing contractual right.

QUESTIONS / PERMISSION / CORRECTIONS

For a reuse request, email us to obtain our permission-request form. Completing the form or receiving an email approval does not grant permission. Restricted use may begin only after both parties sign the licence agreement, it takes effect and its pre-use conditions are met.
